By using our Services, you agree to these Terms in full.

If you do not agree with these Terms, please discontinue use of the website and related services immediately.

1. Purpose of the Platform

PayByPrice.com operates primarily as:

A truck and machinery sourcing platform
A lead-generation site for ATS Commercial Trucks
An information and contact point for buyers seeking commercial vehicles

We do not act as a financial services provider, auctioneer, or government vendor unless expressly indicated.

2. Accuracy of Information Provided by Users

To successfully source a vehicle, users are required to provide honest, accurate, and complete information. This includes:

Contact details
Truck specifications
Budget
Urgency of request
Additional requirements

Failure to provide accurate information may result in delays or inability to source a suitable vehicle. We are not liable for outcomes caused by incomplete or misleading information.

3. Service Fee

When a truck is sourced through us, a service fee of 2% – 5% of the purchase value applies unless otherwise agreed in writing. This fee:

Covers sourcing, pre-check verification, vendor communication, and coordination
Is payable on successful sourcing and acceptance of a truck by the buyer
Is non-refundable once a deal is concluded

A commitment fee may apply for high-priority or special requests.

4. Nature of Our Role

We act as a sourcing partner, not the seller, unless the vehicle is explicitly listed as our stock. Our responsibilities may include:

Locating available trucks
Basic verification checks
Facilitating communication between buyer and seller
Negotiation assistance
Coordinating inspections and delivery (not performed by us directly)

We do not guarantee the mechanical condition of any vehicle unless stated otherwise. Independent inspection is the responsibility of the buyer.

5. Listings & Availability

Listings may include vehicles from dealers, private sellers, or partner networks.
Availability is subject to change at any time.
Images and descriptions are for informational purposes and may not represent the exact condition of the vehicle.

We make reasonable efforts to ensure accuracy but cannot guarantee completeness of third-party information.

6. User Conduct

Users agree not to:

Provide false, fraudulent, or misleading information
Attempt to exploit the platform for unauthorized sales or data scraping
Engage in abusive, threatening, or inappropriate communication
Misrepresent themselves as dealers, agents, or affiliates of ATS Commercial Trucks

Violation may result in access termination.

7. Third-Party Dealers & Suppliers

When dealing with external suppliers:

We are not responsible for delays, defects, or disputes caused by third parties
Buyers are encouraged to inspect vehicles independently
Any warranties or guarantees are between the buyer and seller

We assist with coordination but are not legally liable for third-party actions.

8. Payments & Transactions

All payments for trucks are strictly between the buyer and the seller.
Service fees payable to ATS Commercial Trucks are separate and invoiced independently.
We do not handle client funds, deposits, or trust accounts unless explicitly stated.

9. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for losses arising from reliance on external sellers
We are not responsible for mechanical failures, defects, or damages after purchase
We are not liable for delays, miscommunications, or transport issues caused by third parties

Your use of the platform and reliance on sourced vehicles is entirely at your own risk.

10. Privacy & Data Usage

We collect user information solely for the purpose of:

Providing truck sourcing services
Communication and follow-up
Improving platform functionality

We do not sell, trade, or publish user data. Data is handled under standard privacy practices.

11. Prohibited Use of the Platform

Users may not:

Post unauthorized listings
Interfere with the platform functionality
Attempt to reverse-engineer, copy, or exploit site design or code
Use the site for unlawful transactions

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the platform after changes indicates acceptance.

13. Termination of Use

We may suspend or terminate access if:

A user violates these Terms
Fraud or misconduct is suspected
Abuse or harassment is directed toward our team or partners

14. Dispute Resolution

Any disputes arising from use of the platform or Services shall first be attempted to resolve through negotiation. If unresolved, disputes may be handled through South African legal channels.
